MP Projects Group reserves the right to adjust a quotation where the actual condition of the site differs materially from what was visible or disclosed before commencement.

Where existing paint, coatings, waterproofing, tiles, roofing materials or other surfaces are retained, MP Projects Group cannot guarantee the condition of the underlying surface where it cannot reasonably be inspected.

7. Roofing & Waterproofing

Roofing and waterproofing work is dependent on the existing condition and construction of the property.

MP Projects Group will take reasonable measures to prepare and waterproof the specified areas. However, waterproofing performance may be affected by:

  • Existing structural movement
  • Poor roof design or drainage

Preparation may include cleaning, pressure washing, removal of loose material, removal of loose coatings where specified, treatment of rust, sealing of cracks and joints, application of bonding/primer products and application of the specified coating system.

The final result may be affected by the condition of the existing surface and materials underneath the coating.

9. Painting & Revamping

Painting and coating prices are based on the agreed scope of preparation and application.

Additional preparation may be required due to:

  • Peeling paint
  • Dampness
  • Cracks
  • Damaged surfaces
  • Rust
  • Previous coatings
  • Other defects

MP Projects Group cannot guarantee that existing stains, marks, damp damage or structural cracks will not reappear where the underlying cause has not been repaired.

10. Materials

Unless otherwise stated in the quotation, MP Projects Group will supply the materials specifically listed in the quotation.

Where the client supplies materials, MP Projects Group will not be responsible for defects, incompatibility, insufficient quantities or failure of client-supplied materials.

11. Client Responsibilities

The client must provide MP Projects Group with reasonable access to the property and work areas.

The client is responsible for informing MP Projects Group of any known defects, previous repairs, leaks, structural problems or other relevant conditions before work begins.

The client must ensure that valuable, fragile or personal items are removed from or adequately protected within the work area.

12. Weather Conditions

Certain work, particularly roofing, waterproofing, painting and coating applications, is dependent on suitable weather conditions.

Rain, excessive moisture, high winds or other unsuitable weather conditions may delay completion of the work.

Such delays will not constitute a breach of contract.

13. Workmanship

MP Projects Group will perform the agreed work with reasonable care and skill.

Any workmanship concern must be reported to MP Projects Group within a reasonable period after completion so that the matter can be inspected and, where applicable, addressed.

14. Warranty

Any warranty offered by MP Projects Group will apply only to the specific products, workmanship and scope stated in the quotation or written warranty.

A warranty will not apply where:

  • Another contractor has worked on or altered the completed area.
  • The area has been damaged after completion.
  • The underlying structure has moved or failed.
  • The client has failed to maintain the relevant area where maintenance is required.
  • Damage has been caused by severe weather or external circumstances.
  • The failure relates to an existing defect not included in the scope of work.
  • The client or another party has modified, repaired or interfered with the completed work.

Product warranties are subject to the manufacturer’s terms and conditions.

15. Completion & Inspection

Upon completion, the client should inspect the work and notify MP Projects Group of any visible concerns.

Minor snagging or agreed outstanding items will be attended to within a reasonable period.

16. Damage Caused by Other Contractors

MP Projects Group accepts no responsibility for damage to completed work caused by other contractors, tradesmen, property owners or third parties after MP Projects Group has completed its work.

If the client cancels the project after materials have been purchased, ordered or work has commenced, the client may be liable for costs already incurred by MP Projects Group, including materials, labour, transport and other reasonable project-related expenses.

18. Site Conditions

The client acknowledges that construction and renovation work can uncover conditions that cannot reasonably be identified before work begins.

Such conditions may require additional work, materials, labour or time and will be treated as additional work.

19. Payment Default

If payment is not made when due, MP Projects Group reserves the right to stop work until the outstanding amount has been settled.

Any additional costs arising from delays caused by non-payment may be charged to the client where applicable.

20. Liability

MP Projects Group will not be liable for pre-existing structural defects, hidden defects, failures of existing materials, work performed by other contractors, or damage resulting from circumstances outside MP Projects Group’s reasonable control.

21. Client Approval

By signing the quotation or making payment of the required deposit, the client confirms that they have read, understood and accepted these Terms & Conditions and the scope of work provided by MP Projects Group.
